Complete Terms & Conditions 

These Terms & Conditions apply to scheduled group photography workshops and photo tours offered by Christine Kenyon. Private tours, custom workshops, and specially arranged programs may be governed by separate written terms.

By submitting a deposit or other payment, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

LICENSES, CERTIFICATIONS & INSURANCE

Christine Kenyon obtains and maintains the commercial permits and authorizations required for each workshop location, where applicable. Christine maintains current First Aid and CPR certifications and carries appropriate business liability insurance.

DEPOSITS & PAYMENT SCHEDULE

A deposit is required to reserve your seat in a workshop. Your reservation is not confirmed until your deposit has been received.

The remaining balance is due in full 120 days before the workshop start date. If you book within 120 days of the workshop, full payment is due at the time of booking.

Failure to pay the balance by the payment deadline may result in cancellation of your reservation so that the seat can be offered to another participant. Any amount already paid will then be handled according to the Participant Cancellation Policy below.

Except as specifically provided in these Terms & Conditions, all payments are non-refundable.

PARTICIPANT CANCELLATION POLICY

All cancellation requests must be submitted in writing by email. Your cancellation becomes effective on the date it is received.

A $250 cancellation fee applies to all participant cancellations.

If Your Seat Is Filled

If your canceled seat is filled by another participant before the workshop begins, you will receive a refund of the payments you made, less:

• the $250 cancellation fee;

• any documented, nonrecoverable expenses incurred specifically on your behalf, such as lodging, guide, permit, reservation, or third-party booking costs; and

• any difference between the amount you paid and the amount received from the replacement participant.

Your seat is considered filled when a replacement participant has completed the booking process and made the required payment.

Any refund will be issued after the replacement participant’s payment has been received and successfully processed. The amount refunded cannot exceed the net amount recovered by filling your seat.

If Your Seat Is Not Filled

If your seat is not filled before the workshop begins, no cash refund will be issued. The payments you made will be converted to a workshop credit, less:

• the $250 cancellation fee; and

• any documented, nonrecoverable expenses incurred specifically on your behalf.

WORKSHOP CREDITS

A cancellation credit belongs solely to the original participant. It may not be transferred, sold, assigned to another person, or redeemed for cash.

The credit retains its full remaining value for 12 months from the original workshop start date.

After 12 months, the remaining credit will be reduced by 50%. The reduced credit may be used for an additional 12 months.

Any unused credit expires 24 months after the original workshop start date.

Credits may be applied toward any available scheduled group workshop offered by Christine Kenyon. If the new workshop costs more than the available credit, you are responsible for paying the difference according to the standard payment schedule.

Workshops purchased in whole or in part with a cancellation credit are not eligible for discounts or promotional pricing.

If you cancel a workshop booked using a cancellation credit, all credit applied to that booking, along with any additional payments made toward it, will be forfeited.

Credits are subject to workshop availability and do not guarantee a seat in any particular workshop.

NONRECOVERABLE EXPENSES

If your cancellation results in nonrecoverable expenses that were incurred specifically on your behalf, those expenses may be deducted from any refund or credit otherwise available to you.

These expenses may include, but are not limited to, individual lodging reservations, guide fees, permit fees, transportation arrangements, or other third-party costs that cannot reasonably be recovered.

CANCELLATION BY CHRISTINE KENYON

Christine Kenyon reserves the right to cancel a workshop before it begins because of insufficient enrollment, illness or incapacity, safety concerns, severe weather or environmental conditions, government restrictions, permit or access issues, wildfire, natural disaster, or other circumstances that make conducting the workshop unsafe, unlawful, or impractical.

If Christine cancels the entire workshop before it begins, you may choose either:

• a full refund of the workshop fees you paid to Christine Kenyon; or

• a credit for the full amount paid, valid for 24 months from the scheduled workshop start date.

A refund or credit of workshop fees is the sole remedy for a workshop canceled by Christine Kenyon.

Christine is not responsible for airfare, lodging, rental vehicles, transportation, meals, travel insurance, equipment rentals, lost income, or any other personal or travel-related expenses. For this reason, travel insurance and refundable travel arrangements are strongly recommended.

WEATHER & NATURAL CONDITIONS

Photography workshops take place in natural environments where weather, light, visibility, cloud cover, smoke, wildfire conditions, foliage, wildlife, road conditions, and other environmental factors are unpredictable.

Although Christine will make every reasonable effort to provide the best experience possible under the conditions presented, no particular weather, light, subject, access, photographic opportunity, or resulting image can be guaranteed.

Unfavorable weather or photographic conditions do not entitle a participant to a refund or credit.

Christine may change meeting times, photography locations, routes, schedules, activities, or other portions of the itinerary in response to weather, safety concerns, access restrictions, road conditions, environmental conditions, or other logistical circumstances.

A change to the itinerary, schedule, route, or photography location does not constitute cancellation of the workshop.

If conditions before the workshop create a significant safety risk or make conducting the workshop impractical and Christine cancels the entire workshop, the Cancellation by Christine Kenyon policy applies.

WORKSHOPS INTERRUPTED AFTER THEY BEGIN

If a workshop must be delayed, relocated, modified, shortened, or ended after it has begun because of weather, wildfire, road closures, government action, natural disaster, medical emergency, safety concerns, or another circumstance beyond Christine’s reasonable control, no refund or credit will ordinarily be issued.

Christine will make reasonable efforts to provide suitable alternative locations or activities when circumstances permit, but alternatives cannot be guaranteed.

TRAVEL INSURANCE

Comprehensive travel insurance is strongly recommended.

Participants should consider coverage for trip cancellation, interruption, illness, medical emergencies, evacuation, delayed or canceled transportation, baggage, equipment, and other unexpected travel disruptions.

Christine does not sell insurance and cannot guarantee that any particular event or expense will be covered by an insurance policy. A provider recommendation can be supplied upon request.

PARTICIPANT RESPONSIBILITIES

Photography workshops may involve uneven terrain, darkness, remote locations, altitude, heat, cold, hiking, wildlife, unpaved roads, irregular hours, and limited access to immediate medical assistance.

Each participant is responsible for reviewing the stated activity level and determining whether the workshop is appropriate for their health, physical abilities, experience, equipment, and comfort level.

Participants are responsible for arranging and paying for their own transportation, lodging, meals, rental vehicles, fuel, equipment, and other personal expenses unless the workshop description specifically states that an item is included.

A participant who arrives late, leaves early, misses an activity, chooses not to participate, or is unable to attend because of illness, travel disruption, transportation problems, or personal circumstances is not entitled to a refund or credit.

VEHICLES & TRANSPORTATION

Unless otherwise stated in the workshop description, participants are responsible for arranging their own transportation.

Participants are responsible for ensuring that any personal or rental vehicle used during the workshop is suitable for the stated road and weather conditions and is properly licensed, maintained, registered, and insured.

Each participant is responsible for their own driving decisions and for complying with traffic laws, rental agreements, land-management requirements, and vehicle restrictions.

Carpooling with Christine or another participant may sometimes be possible, but it is not guaranteed. A participant who rides in another person’s vehicle does so voluntarily.

PARTICIPANT CONDUCT

Participants must follow applicable laws, permit requirements, land-management rules, and reasonable safety instructions provided by Christine or an authorized guide.

Christine reserves the right to refuse participation in a particular activity or remove a participant from a workshop if the participant:

• presents a safety risk to themselves or others;

• repeatedly disregards safety instructions;

• is impaired by alcohol, illegal drugs, or misused medication;

• engages in threatening, abusive, harassing, illegal, or seriously disruptive behavior;

• damages property or natural or cultural resources; or

• substantially interferes with the safe and reasonable operation of the workshop.

A participant removed for such conduct will not receive a refund or credit and will be responsible for arranging and paying for their own departure and transportation.

THIRD-PARTY SERVICES

Some workshops may involve services provided by independent guides, lodging providers, transportation companies, landowners, outfitters, or other third parties.

These providers may impose their own terms, requirements, waivers, and cancellation policies.

Christine Kenyon is not responsible for the acts, omissions, delays, cancellations, or service failures of an independent third-party provider or for expenses resulting from those circumstances.

LIABILITY RELEASE & ASSUMPTION OF RISK

Participation in an outdoor photography workshop involves inherent risks, including but not limited to personal injury, illness, property damage, wildlife encounters, changing weather, uneven terrain, remote locations, driving hazards, and delayed access to medical care.

By booking and participating in a workshop, you acknowledge that you understand these risks and voluntarily accept and assume responsibility for them.

To the fullest extent permitted by law, you release and agree to hold harmless Christine Kenyon, her authorized guides, contractors, agents, and associates from claims, liabilities, damages, or expenses arising from or related to your participation, including claims resulting from ordinary negligence.

This release does not apply to gross negligence, reckless or willful misconduct, intentional harm, or any liability that cannot legally be waived.

You are responsible for your own medical, evacuation, transportation, and related expenses. You are also responsible for safeguarding your cameras, equipment, vehicles, baggage, and other personal property.

Christine is not responsible for the loss, theft, damage, or malfunction of personal property except to the extent that liability cannot legally be excluded.

ITINERARY & PROGRAM CHANGES

Detailed itineraries are provided as a general plan and are subject to change.

Christine reserves the right to change photography locations, schedules, accommodations, transportation arrangements, or other logistical details when reasonably necessary because of weather, safety concerns, access restrictions, permit requirements, environmental conditions, or other circumstances.

GOVERNING LAW & VENUE

These Terms & Conditions are governed by the laws of the State of Utah.

To the extent permitted by law, any legal action arising from these Terms & Conditions or participation in a workshop must be brought in a court having jurisdiction in Utah County, Utah.

SEVERABILITY

If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision will be modified or removed only to the extent necessary. The remaining provisions will continue in full force and effect.

STATEMENT OF AGREEMENT

By submitting a deposit or other payment, you acknowledge that you have read, understood, and agreed to these Terms & Conditions, including the payment schedule, participant cancellation policy, workshop credit terms, weather policy, assumption of risk, and limitations of responsibility.

You understand that workshop itineraries and photography locations may change because of weather, natural events, access restrictions, safety concerns, or other logistical circumstances.

You also understand that participation in an outdoor photography workshop involves inherent risks and that you are voluntarily choosing to participate subject to these Terms & Conditions.
